Welcome to the Creative Adventure, Namibia Experience hosted by Felix Kunze & Pratik Naik (the “hosts”) with co-host Bella Kotak. By registering for this event, you acknowledge that you have read, understood, and agree to the following legally binding Terms & Conditions.
1. Booking & Payment
1.1. A non-refundable deposit of USD [$2999] is required to secure your booking.
1.2. The remaining balance must be paid in full by 15 November 2025.
1.3. Failure to pay in full by the deadline may result in cancellation of your booking without refund.
1.4. Bookings are non-transferable unless explicitly approved in writing by the hosts.
2. Cancellations & Refunds
2.1. All cancellations must be submitted in writing.
2.2. Deposits are strictly non-refundable.
2.3. Cancellations made after 1 November 2025 are non-refundable in full.
2.4. The hosts reserve the right to cancel the event due to insufficient participants, safety concerns, or other operational reasons. In such case, all payments made will be refunded, and this shall be the sole and exclusive remedy.
2.5. If you are unable to attend, the hosts may attempt—but are not obligated—to resell your spot. If successful, you may be refunded amounts paid, less expenses incurred.
3. Travel & Insurance
3.1. Participants are solely responsible for arranging travel to and from the designated start point: past immigration at Windhoek International Airport, Namibia.
3.2. The hosts are not responsible for missed flights, lost luggage, immigration issues, or delays.
3.3. Participants must obtain comprehensive travel and medical insurance that covers trip cancellation, evacuation, accident, illness, disability, and death. Proof of insurance may be requested prior to participation.
4. Health & Safety
4.1. Participants must disclose any medical conditions, allergies, or limitations that could impact participation.
4.2. The hosts reserve the right to refuse participation to anyone deemed medically unfit or unsafe.
4.3. You acknowledge that the experience may include exposure to physical exertion, rough terrain, wildlife, vehicle travel, dust, heat, cold, and other risks inherent to travel in Namibia.
4.4. You expressly assume all risks associated with participation, including but not limited to illness, injury, disability, permanent paralysis, or death, whether caused by negligence of the hosts, their contractors, other participants, or otherwise.
5. Release of Liability & Indemnity
5.1. To the maximum extent permitted by law, you hereby waive, release, and discharge the hosts, their officers, contractors, employees, agents, successors, and assigns from any and all claims, demands, damages, liabilities, losses, or causes of action, including those for bodily injury, illness, death, emotional distress, or property damage, arising out of or related to your participation in the experience.
5.2. This release applies even if such claims arise from the negligence (but not gross negligence or willful misconduct) of the hosts.
5.3. You agree to indemnify, defend, and hold harmless the hosts from any claims, costs, damages, or expenses (including attorney’s fees) brought by third parties as a result of your actions or participation.
5.4. You understand that this is a complete and unconditional release of liability to the fullest extent allowed by law.
6. Changes to the Program
6.1. The hosts reserve the right to alter itineraries, schedules, accommodations, or activities for safety, weather, logistical, or operational reasons.
6.2. Substitutions of hosts, staff, or guides may be made without notice.
6.3. No refunds will be issued due to changes that are outside the hosts’ control.
7. Personal Belongings
7.1. Participants are solely responsible for their personal belongings, including photography equipment, electronics, documents, and valuables.
7.2. The hosts accept no liability for theft, loss, or damage of personal items, regardless of cause.
8. Photography
8.1. Participant-Created Images
Participants retain full copyright and ownership of all images they create during the Experience.
By attending, you grant the Hosts a perpetual, worldwide, royalty-free license to use, reproduce, display, and distribute your images for promotional purposes related to the Creative Adventure Namibia and future experiences of a similar nature.
The Hosts will make every reasonable effort to provide credit to the photographer where practicable (e.g., social media, website, press features), but cannot guarantee credit in all instances.
The Hosts will not sell, sub-license, or otherwise transfer participant images to unrelated third parties. However, the Hosts may use and share participant images in connection with future promotional partnerships that directly relate to similar creative experiences (e.g., collaborations with travel, gear, or education partners).
8.2. Host-Created Images
Images created by the Hosts and their team during the Experience remain the property of the Hosts, who may use them in any manner for promotional or commercial purposes.
9. Likeness & Media Release
9.1. Use of Likeness
By attending, you grant the Hosts permission to capture and use your likeness (including photographs, video, and audio recordings) for promotional and marketing purposes, in any media, worldwide, in perpetuity.
9.2. Third-Party Use for Promotion
This includes the right to share likeness-based content with third parties for the sole purpose of promoting the Experience or future similar experiences (including through brand partners, press outlets, or social media platforms).
No royalty or compensation will be due for such use.
9.3. Opt-Out Option
If you prefer not to appear in promotional material, you must notify the Hosts in writing before the Experience begins. The Hosts will make reasonable efforts to accommodate such requests, but cannot guarantee complete exclusion from group media.
9. Code of Conduct
9.1. Participants must act respectfully toward all attendees, staff, local communities, and wildlife.
9.2. Any behavior deemed dangerous, disruptive, or inappropriate (including harassment, violence, or substance abuse) may result in immediate removal from the event without refund.
10. Alcohol & Substances
10.1. Responsible alcohol consumption is permitted.
10.2. The possession or use of illegal substances will result in immediate dismissal without refund and may be reported to authorities.
11. Force Majeure
11.1. The hosts are not responsible for cancellations, delays, or changes due to events beyond their control, including but not limited to natural disasters, pandemics, political unrest, government restrictions, or acts of God.
11.2. In such cases, refunds are not guaranteed, though reasonable efforts will be made to minimize participant loss.
12. Governing Law & Dispute Resolution
12.1. These Terms & Conditions, and any dispute or claim arising out of or relating to the Experience, shall be governed exclusively by the laws of Namibia, without regard to conflict-of-law principles.
12.2. Any legal action, arbitration, or proceeding shall be brought only in the courts of Namibia, and you hereby irrevocably submit to the exclusive jurisdiction of such courts.
12.3. Participants waive any objection to venue or forum and agree not to bring claims in any other jurisdiction.
12.4. To the extent permitted by Namibian law, participants waive the right to trial by jury and agree that any dispute shall be resolved through binding arbitration or mediation in Namibia, at the Hosts’ discretion, before resorting to litigation.
13. Acknowledgment of Understanding
By registering, you acknowledge that you have carefully read this agreement, fully understand its terms, and voluntarily agree to be bound by it. You understand you are giving up substantial legal rights, including the right to sue for ordinary negligence, and you sign/agree freely and voluntarily.
